Who we are
Spark Plan Check is run by ClarityIntel Pty Ltd, a company registered in Australia (ABN 54 697 254 596), we. Solar, battery and EV charger installers in Great Britain use it to work out which electricity tariff suits a customer's home and the system they're installing, and to give their customer a private link to the result.
Our UK representative under Article 27 of the UK GDPR is Prighter Ltd. You can contact it about anything in this notice at app.prighter.com/portal/14260907372.
Whose information we hold, and our role
Homeowners (the installer's customers). Your installer decides to use Spark for you and is the controller of your information. We process it on your installer's behalf, under a contract that meets the UK GDPR. Your installer enters:
- your name, and your email address if they choose to;
- your address, and your meter number (MPAN) if they have it;
- your current supplier;
- figures from one of your electricity bills: the days it covers, how much power you used, how much solar you sent to the grid, and the bill's total. Your installer may type these in, or upload a photo or PDF of the bill for us to read them from. We don't keep the photo or PDF: only the figures read from it;
- the system you're getting: battery size and charge rate, solar size, inverter, and if you have an electric car, how far you drive and your charger's rate.
From those, we work out your result: the tariffs priced for your home, the one that suits, and the saving. How much power you use and when can say something about when you're home, so we treat this information with particular care.
Installers' people, and installers who ask about Spark. For these we're the controller: your name, work email, the installer you work for and when you sign in; and what you send us on the website (business name, your name, email and phone, roughly how many batteries you install, the plan and any postcode districts you're interested in). We delete an enquiry after 12 months if you don't go ahead.
Everyone who visits. Our hosting provider records technical details of each visit (internet address, browser, the page asked for and when) to keep the service secure and working. We don't use advertising or analytics cookies or trackers. We set one strictly necessary cookie, only when an installer's person signs in, to keep them signed in.
We don't ask for, and you shouldn't give us, bank or card details, or special category data such as health details.
Why we use it, and our lawful basis
- To prepare and show a homeowner's result (on the installer's behalf): the installer's lawful basis is theirs to set out; ours, as their processor, is the contract with them.
- To run accounts for installers' people: contract with the installer, and our legitimate interests in running a secure service.
- To reply to installers who ask about Spark: steps at their request before a contract, and our legitimate interests.
- Security, fixing faults, and records the law requires: legitimate interests and legal obligation.
- Yearly re-checks, if the installer switches them on: we price the homeowner's tariffs again each year on the same figures and tell the installer if another tariff would save money. We don't contact the homeowner.
- Improving the service, using information that can't identify anyone.
We don't sell personal information, give it to suppliers, or use it to market anything to homeowners. We email installers' people only about the service, such as their sign-in code.
Decisions made by computer
The recommended tariff is worked out by our software, from the figures entered and the suppliers' published tariffs, without a person deciding it. It's a recommendation with no legal or similarly significant effect: whether to switch is entirely the homeowner's choice, and nothing happens unless they sign up with the supplier themselves. The result page explains what the prices assume and why that tariff was chosen. If you think a result is wrong, tell your installer or email us, and a person will look at it.
Who we share it with
- The installer, who can see the results for its own customers. Each installer sees only its own customers.
- Service providers (our subprocessors) who help us run Spark, only to do that, and bound to protect it:
| Provider | What they do | What they receive | Where |
|---|---|---|---|
| Cloudflare, Inc. | Hosting, database, file storage, security | Everything in Spark | Database primary location in the Oceania region; Cloudflare's network processes requests worldwide |
| Google LLC (Places) | Completes an address as an installer types it | The part-address being typed | United States |
| Resend, Inc. | Sends sign-in emails to installers' people | Name and email address | United States |
| Anthropic, PBC | Reads a bill an installer uploads, so the figures don't have to be typed | The bill as uploaded (name, address, meter number, supplier, usage and charges) | United States. Under Anthropic's commercial terms it isn't used to train its models |
- Suppliers' published tariff data (for example Octopus Energy's) is fetched using only the postcode, to find the region. No other information is sent.
- If the law requires it, for example to a court or the ICO.
- If the business is sold, to the buyer, who must keep to this notice.
International transfers
Information is held in our database hosted by Cloudflare, with its primary location in the Oceania region, and is handled by ClarityIntel in Australia. Australia doesn't have a UK adequacy decision, so these transfers are protected by the UK International Data Transfer Addendum to the EU standard contractual clauses, in our contract with each installer and supported by a transfer risk assessment. Transfers to our providers in the United States rely on the UK Extension to the EU–US Data Privacy Framework where the provider is certified, or the same Addendum. Ask us for a copy of the safeguards at privacy@sparkplancheck.com.
How we protect it
Information is encrypted in transit and when stored. Sign-in uses a one-time code or link sent by email, with an extra step for our own staff. Each installer sees only its own customers. Each homeowner's link is a long random address that can't be guessed, but anyone who has it can open it, so please keep yours private.
How long we keep it
Each plan check is kept for 2 years from when it was last run (or last re-checked, if the installer has yearly re-checks on), then deleted, unless the installer deletes it sooner or you ask us to. If an installer stops using Spark, its customers' information is deleted within about 3 months of that. Backups are overwritten within a further 35 days.
Your rights
You can ask to see, correct or delete your information, to restrict or object to how it's used, or for a copy to take elsewhere. For a homeowner's result, we'll pass your request to your installer, who controls it, and help them answer. Email privacy@sparkplancheck.com. We'll reply within one month. We may need to confirm who you are first. We don't charge for this.
Complaints
Email privacy@sparkplancheck.com and tell us what happened. We'll reply within one month. You can also complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.
Changes
We'll post any change here, with the date. If a change affects how we use information we already hold, we'll tell installers first.
